9th Circuit Upholds Finding For Insurer Over Benefit Denial
SAN FRANCISCO - The Ninth Circuit U.S. Court of Appeals on May 13 in an unpublished opinion upheld a District Court’s finding that an ERISA-governed disability insurer acted reasonably in terminating benefits to a claimant with back problems (Gregory Scherr v. Fleetboston Financial Corporation Long Term Disability Plan, No. 2:06-cv-04050, 9th Cir.; 2009 U.S. App. LEXIS 10365).
