Appellate Court Reverses, Rules Vaccine Plaintiffs Need Not Return Samples
TRENTON, N.J. - Plaintiffs who obtained samples of American Home Products’ Orimune polio vaccine and vaccine component to test for simian virus 40 (SV40) contamination may retain those samples under conditions while the litigation is pending, the New Jersey Superior Court Appellate Division ruled Nov. 20 in reversing a trial judge’s ruling (David Rivard, et al. v. American Home Products, et al., No. A-1244-08T2, N.J. Super., App. Div.; See March 2007, Page 6).
