Appellate Panel Finds 2 Members Of NLRB Does Not Constitute Quorum
WASHINGTON, D.C. - A National Labor Relations Board (NLRB) ruling issued by just two members does not meet the NLRB’s statutory quorum requirement, the District of Columbia Circuit U.S. Court of Appeals ruled May 1, rejecting the NLRB’s argument that powers could be delegated to a group of three, giving a two-member panel quorum status (Laurel Baye Healthcare of Lake Lanier, Inc. v. National Labor Relations Board, No. 08-1162, D.C. Cir.; 2009 U.S. App. LEXIS 9419; See November 2008, Page 43).
