Plan Participants, Amici Ask 7th Circuit To Rehear Revenue-Sharing Case

CHICAGO - Participants in the Deere & Co.’s 401(k) plans, the U.S. Department of Labor and several consumer groups are urging the Seventh Circuit U.S. Court of Appeals to reconsider its ruling that the plan sponsor and service providers did not breach fiduciary duties by failing to disclose revenue-sharing agreements or limiting the investment options to those offered by the service provider’s affiliate (Dennis Hecker, et al. v. Deere & Company, et al., Nos. 07-3605, 08-1224, 7th Cir.; See March 2009, Page 5).
