Woman Appealing Sanctions Ruling Based On Discarded Laptop
HARRISBURG, Pa. - A woman on March 16 filed a notice of appeal seeking to reverse a federal judge’s ruling dismissing her antitrust claims and imposing an adverse inference jury instruction as a sanction for her decision to knowingly discard a laptop containing e-mails directly related to her action without preserving them and her failure to properly explain why she did not preserve the e-mails (Nancy C. Kvitka, et al. v. The Puffin Company, et al., No. 06-CV-0858, M.D. Pa.; 2009 U.S. Dist. LEXIS 11214).
